Intellectual Property Law Policy: National and International
This course studies the relationhip of international treaties, regional
agreements and bilateral agreements on national IP laws. It examines
the policies that influence the development of national IP laws.
Lab to Market, Joint Law School and Business School Program, University

This program was jointly conceived in early 1990 by Lanny Herron, Neil
Kleinman and William T. Fryer, III. A $1,000,000 federal grant was
obtained to develop the curriculam for this course. During that time
each of the originators was integrally involved in teaching and planning
development of these courses. The structure included the following
courses: Opportunity Analysis (OA), the Commercialization Planning
(CP) and the Commercial Implementation (CI), where students from the law,
business and other schools work in teams to evaluate real technology
from government labs and other sources, and plan technlogy commericalization.
The The OA and CP courses were cross listed as law and graduate Business
School courses. This program continued under the direction of Professor
Herron, and it has been refined extensively. Professor Michael Laric
now administers this program. The OA course is the only one that

2012 Back to 2008 Summary Introduction. The following activity update summary covers an extended period, including the change on July 1, 2009, from full time professor to Professor Emeritus at the University of Baltimore School of Law. Some of my academic professional activities have continued.
2012 White House Office of IP Enforcement Coordinator Strategic Plan Comments. Recommendations were submitted on August 10, 2012, supporting direct access to Customs and Border Patrol IP infringement enforcement for design patent owners, government sponsored education to improve increase use of U. S design patent and foreign design protection, and White House support for passage of S.3486 (112 Cong., 1st Sess.) that will enable prompt U. S. membership in the Hague Agreement Concerning the International Registration of Industrial Designs.
2012 AIPLA Committee on Designs. As a member of the American Intellectual Property Law Association (AIPLA), Committee on Designs, I participated in the review of the draft legislation prepared by the U. S. PTO for implementing the Hague Agreement Concerning the International Registration of Industrial Designs. The legislation was filed on August 2, 2012, S.3486 (112 Cong., 1st Sess.).
2012 ATRIP Meeting at IIT-Chicago Kent College of Law. I attended the annual meeting of the International Association for the Advancement in Teaching and Research in Intellectual Property (ATRIP), held in Chicago, Illinois, on July 29 to August 1, 2012. The main topic was Intellectual Property: Economic Analysis Methods and Perspectives
2012 WIPO Summer Course on Trademarks. The UN-World Intellectual Property Organization Summer Course on Trademarks was held at the U. S. Patent ad Trademark Office, July 23 to August 3, 2012. The sessions I taught in that course were: (1) The Hague System for the Registration of Industrial Designs: Practical Approach, (2) Design Protection and its Interfaces with other Industrial Property Rights, and (3) Case Studies on Three-Dimensional marks. In addition, I moderated a small group discussion on Color protection by Trademarks, and assisted the group in preparing their presentation at the plenary session.
2012 U. S. PTO. For several years the U. S. Patent and Trademark Office (U. S. PTO) has co-sponsored and helped organize with several professional organizations an annual Design Patent Day. I attended the April 10, 2012, event which had over 300 attendees, and speakers from companies on how to use design protection rights. A presentation by Hewlett-Packard on its product industrial design enhancement project was a highlight of the program.
2011 U. S. PTO. The U. S. PTO has a significant education global outreach. I presented a paper at the U. S. PTO Global IP Law Academy on July 13, 2012, to a group of foreign design offices administrators, on the history of the Hague Agreement Concerning the International Registration of Industrial Designs.
2010 Stanford University Law School (Stanford) and UN-World Intellectual
Property Organization (WIPO) Program. On May 20, 2010 I attended
a conference at Stanford on future developments in IP law. My contribution
was to presented a paper on the history, operation and need for the
U. S. to become a member of the Hague Agreement Concerning the Registration
of Industrial Designs.

2008 International Trademark Association. A major experience
for me was to present a paper and participate in a debate on U. S.
And foreign design protection at the annual International Trademark Association
meeting, May 18 to 20, 2009, in Seattle, Washington. It was
an energetic and well attended debate on the advantages and weakness of
proposed and existing forms of U. S. and foreign design protection.
2008 and 2011 ATRIP. I attended the ATRIP annual meetings in 2008 (Munich, Germany - Max Planck Institute), and 2011 (Singapore National University of Singapore and IP Academy). These events were important opportunities to gain insight on international law developments. At the Singapore meeting I presented a report on significant U. S. IP law developments. During the Singapore visit I had the pleasure of meeting with Anne Loo, Director & Legal Counsel (Registration Division) and Maslina Malik, at the Singapore IP Office, to discuss the Singapore's experience in being a member of the Hague Agreement Concerning the International Registration of Industrial Designs.
2008 Congressional Testimony. On February 14, 2008, I present testimony at a U. S. House of Representatives hearing, primarily on legislation amending the Vessel Hull Design Protection Act (17 U. S. C.§§ 1301-1332.
2008, 2011, and 2012 WIPO. The opportunity to research at the WIPO library in Geneva, Switzerland for a full month, in 2008, 2011 and 2011, been a important contribution to keeping up on international IP developments. This work laid the ground work for several publications. I Participated in the WIPO, Standing Committee on Trademarks, Industrial Designs (SCT) in 2011 and 2012, representing the International Association for the Advancement of Teaching and Research in Intellectual Property (ATRIP). The SCT has started a project to harmonize design registration practice. These meeting were useful forums for discussing improvements in design protection.
2008 - 2012 American Bar Association, Section of Intellectual Property Law (ABA, Section of IP Law). I continue as the ABA, Section of IP Law liaison to the ABA, Section of International Law, UN International Institutions Coordinating Committee (UNIIC). This assignment is to inform ABA, Secton of IP Law leadership on significant activities in the UN related to IP law and to be involved in the UNIIC work. As a part of this role I participated in the ABA, IP Law Section monthly telephone and meetings of Council, when possible.
2008-2009 American Bar Association, Section of Intellectual Property Law. Chaired Committee 402 on University Intellectual Property Committee.
2008-2009 American Intellectual Property Law Association (AIPLA). The AIPLA has been a major force in IP law education and legislation. I attended the AIPLA annual meetings in 2008 2011, in Washington, D. C. As a member of the AIPLA Designs Committee I participated in subcommittee report on the pending Fashion Design legislation.
The 2007 American Bar Association (ABA), Section of Intellectual Property Law Leadership meeting was held in Bloomingdale, Indiana, on November 2-5, 2007, where I presented reports on my work as co-chair of Committee 412 (Industrial Designs) and as liaison for the Section to the UN Coordinating Committee of the ABA Section of International Law.
I coordinated the visit on October 25, 2007, of Ted Davis, a nationally recognized trademark attorney, to give a public lecture and teach a class on advanced trademark law topics at the University of Baltimore School of Law.. A reception was organized for Maryland trademark attorneys and our alumni who are trademark examiners at the U. S. Patent and Trademark Office to meet Ted and each other. One of the goals was to increase the recognition of the school as a leader in trademark law education.
The American Intellectual Property Law Association 2007 annual meeting was held in Washington D.C., on October 18, 2007, where I attended some of the events, including the meeting of the Industrial Designs Committee.
I organized a conference, held at the University of Baltimore School of Law on October 13, 2007, on U.S. Patent Law Reform pending legislation. Roy Craig and Bill Ramsey, patent attorney alumni of our school and myself explained the proposed changes found in H.R. 1908, 110 the Congress, 1st session.
At the request of the Institute of Intellectual Property (IIP), a research organization associated with Japanese industry and the Japanese Patent Office, I was invited to a meeting held in Bethesda, Maryland, on September 24, 2007, with members of an IIP committee to review how to improve Japanese law on protection of type face design. I prepared a report for this group on the history of U.S. protection for this subject matter and the report was discussed with the committee.
I attended the annual meeting of American Bar Association, held in San Francisco, CA, August 15-19, 2007, where I participated in the business session debate on key Section of Intellectual; Property Law resolutions and I attended the Committee Chairs meeting.
I presented a paper: "Recent Changes in United States Trade Dress Law," at the annual ATRIP (The International Association for the Advancement of Teaching and Research in Intellectual Property), in Buenos Aires, Argentina, on July 16-18, 2007. I participated in a panel discussion with professors from around the world on industrial design protection. The meeting was hosted by the National Law School.
I served on the committee organizing an IP Maryland State Bar Association Intellectual Property Section. The Section was officially set up in June 2007and I am served as a member of the Section Council for the period 2007- 2009-. I helped prepare the bylaws, and I inserted in the bylaws that a member of the University of Baltimore Law School faculty and the University of Maryland Law School faculty must be on the Council.
A special event, Design Patent Day at the U.S. Patent and Trademark Office (PTO) was planned by several intellectual property law groups. For the American Bar Association, I participated in the planning. The event was held on April 14, 2007. I made the primary contact with the PTO to initiate the event.
I attended the Annual Continuous Legal Education program of the American Bar Association, Section of Intellectual Property Law, held April 12-14, 2007, at which I organized and moderated a meeting of the Industrial Designs Committee (412) on the subject of the pending U.S. ratification of the Geneva Act of the Hague Agreement.
On March 29, 2007. I participated in a Faculty program at the University of Baltimore School of Law that discussed patent protection of accounting and tax computer programs.
As background for a new activity, an audio-vide documentary was made by Japanese professional TV camera crew in March 2006 of my lectures on U.S. design patent law and the Geneva Act of the Hague Agreement, for use in Japanese law schools intellectual property law education. In 2007, I attended a conference related to these documentary films, held in Japan to view my video tapes and video tapes of other experts from around the world. The International Conference, held in Tokyo, on April 2 and 3, 2007, was for the purpose of viewing part of the 100 hours of documentation and to discuss how to use these document in teaching IP law. Several Japanese law schools were involved in this project, with teams of professors planning the work. Experts from many countries who had provided documented lectures were invited to the conference.
The University of Baltimore School of Law competed in the annual American Intellectual Property Law Association moot court competition was held Boston, MA, March 16-18, 2007. The team reached the regional semifinal round. As coach of the time for the last 26 years, I worked with the team on brief preparation and in organizing the oral practice rounds in this unique program, as well as accompanying the team to work with them during the regional competition.
I presented a paper: "The Hague Agreement on the Protection of Designs," at the University of Akron School of Law, March 12, 2007, as a part of its 9th Annual Richard C. Sughrue Symposium on Intellectual Property Law and Policy Beyond Our Borders, International IP Law and Other Trends. During this visit, on March 13, 2007, I gave a talk to the University of Akron Law School IP Law Society on "Global Industrial Design Protection Hot Spots", and to the school faculty on "Dramas at the UN and Other International Organizations."
As a member of the American Intellectual Property Law Association (AIPLA), I was involved in several projects. The major one was to participate in the planning of the review by the AIPLA Board of the Geneva Act of the Hague Agreement. I provide advice to the chair of the AIPLA Industrial Designs Committee and attended the Midwinter meeting in New Orleans, LA, January 25 to 28, 2007, where a program was held by the AIPLA Design Committee. I helped organize that program. A resolution by the committee was prepared and approved, and I proved guidance on that process. At this meeting the AIPLA Board approved the resolution which supported U.S. ratification of the Geneva Act of the Hague Agreement. As a part of the resolution topic process.
The U.S. Patent and Trademark Office (PTO) organized an international conference at the PTO for officials of foreign design offices, held November 27 to December 1, 2006. I was invited by the PTO to participate in that meeting. I attended several days of the event meeting many officials and discussed common topics of interest. I gave a short talk at the meeting on the history of the Geneva Act of the Hague Agreement.
I attended the ABA, Section of IP Law Leadership Meeting, held in Phoenix, Arizona, November 10-13, 2006. I gave a report, as co-chair, on the activities of Committee 412 (industrial Designs), and participated in other leadership sessions . I am also on Committee 102 (International Patents, Subcommittee on China Patent Law Reform), subcommittee on China IP Law and on Committee 304 (Pictorial Graphic and Sculpture).
I attended the annual American Intellectual Property Law Association meeting held in Washington, D.C., including participation its Industrial Designs Committee in Washington, D.C., on October 19, 2006,.
In fall 2006 as co-chair of the Committee
412 (Industrial Designs), and as a former member of the Section Council,
I prepared a letter to President Bush for the ABA, Section of IP Law, in
support of the Geneva Act of the Hague Agreement U.S. ratification.
I helped co-ordinate the letter review by the ABA, and the letter was sent
to the President. Before this letter was sent out I sent a personal
letter to President Bush, in my role as an academic, presenting my views
on ratification, and offering my assistance. My book on this treaty
gave me the status to submit this letter. In a couple of months,
after receiving these letters and other inputs, the President sent the
Geneva Act of the Hague Agreement treaty to the Senate for ratification.
Another important stage in this treaty process is now underway, and I am
very involved in the ABA IP Law Section work on this project.
I submitted comments on November
6, 2006, to the U.S. Patent and Trademark Office (PTO) for its Strategic
Plan 2007-2012, for Draft #6 (August 21, 2006), particularly on how to
improve U.S. design patent administration within the PTO and international
protection of U.S. designs.
As a part of this review, the China Patent Office Head of International Affairs and several other officials had a day long meeting at the U.S. Chamber of Commerce office in Washington, D.C., and I attended that meeting. I discussed some of our Design Patent Committee recommendations with the Director. What is involved is the need for more uniformity in design patent laws. Several insights were gained that have general new topics for research and possible articles. Later a revised draft patent reform bill was furnished to us by the China Patent Office. My committee reviewed this draft and sent comments that were incorporated into a group report. This work has expanded by international view of inter governmental and non governmental cooperation, and it has help me significantly in my IP Law Policy Course preparation.
In the fall of 2006 several ABA Sections of the ABA formed a group to review the China Patent Law Reform legislation. I was selected to review the Design Patent Section, and I chaired a committee on that topic A report was prepared that was incorporated into a general report. I also severed on several other topic committees. A group report, including my committee's recommendations was prepared, this report was approved by the ABA Sections involved and sent to the China Patent Office.
I attended the annual meeting of ATRIP (Association for the Advancement of Intellectual Property Teaching and Research, an international IP law professors organization, September 12-14, 2006, Parma, Italy.
Attended the American IP Law Association annual meeting, Washington, D. C. Industrial Designs Committee meeting, October 19, 2006, and participated in the discussion at that meeting on the Geneva Act of the Hague Agreement.

During the semester break, at the invitation of the Japanese government and Chuo University, participated in several activites in Japan: presented paper on business method paptent related U.S. legislation at the 2000 Tokyo Internet Law Conference, held December 18 and 19, 2000, and participated in a panel discussion at that meeting on this subject with European and Japanese professors. At Chuo University, in Tokyo on December 20, 2000, lectured in an IP course class of 125 students on U. S. patent law changes that harmonized essentially with laws of other countries; following that class, participated in an IP seminar where a final report was presented by students on Japanese unfair competition law design protection, and he lectured on comparative U.S. laws. On December 22, 2000, particpated a meeting at the Japanese Patent Office (JPO) to discuss interpretation of a provision in Japanese design registration law that concerned U. S. practitioners.
Attended annual general meeting and Executive Committee meeting of ATRIP (Association for the Advancement of Teaching and Research in Intellectual Property) in Santorini, Greece, September 18-19, 2000.
Work for two months summer 2000 on various projects WIPO. The projects included assisting in planning a curriculum and web site and teaching in the WIPO Academy and research.

Prepared resolution and obtain approval of IP Section resolution in support of the proposed treaty successful completion.
Conducted research at WIPO June and July 1999, and assisted the WIPO Academy in summer program for visiting scholars.
During the last mentioned visit to Japan in the summer of 1998, lectures and and written papers were presented to the following professional organizations of attorneys at meeting centers in Tokyo: Japanese Design Protection Association - Recent Developments in U. S. Design Patent Protection and U. S. Design Protection Legislation, and the Japanese Trademark Association - The U. S. Debate on Product Design Trademark Protection.
Visiting professor at Chuo University, Tokyo, Japan, for entire month of June 1998. The work included giving lectures in several courses and participating in seminars. For each lecture, a paper in English was distributed to the students, to assist in communications. Lectures were translated into Japanese at intervals during the presentations. The papers presented were: Introduction to the U.S. Patent System: For a Comparative Study; U. S Patent System: First to Invent - A Comparative Study; First to File and First to Invent Systems; Introduction to U.S. Industrial Design Protection; U. S.
